    The reality versus the Remainer Treasury’s fear-mongering fantasies

    On Tuesday the Office for National Statistics published its latest jobs figures. Over one million more people are in employment than immediately prior to the EU Referendum.

    One month before the EU Referendum in 2016, Her Majesty’s Treasury embarked on a massive propaganda exercise designed to scare the living daylights out of the British people, if they dared to vote Leave.

    Below is a Brexit Facts4EU.Org chart, showing HM Treasury’s threats compared to the reality of actual job numbers. As ever we have drawn the actual employment numbers from official government statistics from the ONS, released on Tuesday this week.

    Statistical note : The Treasury was not able to give quarterly estimates for the job falls of up to 820,000 which it predicted. In the chart above we have therefore spread these over the two years period which they were forecasting for the immediate aftermath of a Leave vote.

    About Project Paralysing Fear – by the Treasury and by the UK Government

    On 23 May 2016 the Treasury published its official forecasts of what would happen in the event of a Leave vote. This was their ‘short-term impact assessment’. The long-term impact had already been described by them in a document 5 weeks earlier.

    To be very clear, these were their threats of immediate impacts, not what would happen after the UK exited the EU in what was then thought to be 23 June 2018. In other words, these would be the consequences which would start the moment the British people put their cross in the ‘Leave’ box on the ballot paper.

    These deliberate and wholly false forecasts were then used by the Government, the Remain campaign, and by the BBC and other pro-Remain media organisations – to devastating effect.

    For many ordinary people, the thought of losing your job is catastrophic

    As an example of the grossly inaccurate forecasts, Brexit Facts4EU.Org has chosen one of the most powerful and terrifying of HM Treasury’s many predictions of immediate catastrophe if the British people voted to leave. This was the issue of immediate job losses following a Leave vote.

    For ordinary people, the threat of massive job losses resonates far more than many of the more arcane and complicated arguments about EU membership.

    Exactly one month before the EU Referendum

    Excerpts from the then Chancellor George Osborne’s speech, launching :-

    “HM Treasury analysis: the immediate economic impact of leaving the EU”

    “But what about the immediate impact on our economy? What will it mean next month, next year? And what will it mean for you?”

    “Today the Treasury is publishing its detailed and rigorous analysis of the immediate impact of leaving the EU on growth, jobs, prices, wages, house prices and our nation’s finances.”

    “And the conclusion is that all would be hit.”

    Talking of businesses and families he went on:

    “They won’t take new people on; some will let existing people go. And what about families – how are they likely to respond? Families will also be uncertain about what is coming next.”

    “If you don’t know what’s going to happen to your job, your partner’s job, your pay or the fortunes of the firm you work for – it would make sense to delay spending on things. People will put off trying to buy a home, or starting their own business.”

    “Put together millions of individual decisions like that and there is real damage to the economy.”

    Observations

    As far as we know, no-one in HM Treasury has lost their job as a result of the catastrophic ineptitude of the forecasts.

    In fact the only person to lose his job was the former Chancellor George Osborne whose Department produced the wild claims. Fortunately for him, he was able to replace his job with six new ones.

    This wasn’t a slogan on the side of a bus

    It’s important to note that the forecast of massive job losses wasn’t a slogan on the side of a bus, suggesting something which could be done after the UK left.

    This was official analysis of what would happen immediately. It was the result of detailed ‘macroeconomic and fiscal modelling’, from the government department that is supposed to know how to do this stuff.

    The contrast between the truth, and the deliberate lies of the government, David Cameron, George Osborne, and the civil servants aiding and abetting them could not be more stark.

    The government’s partner in crime, the BBC, then produced a video on the subject and you can see a screengrab of this above. Its then economics editor Kamal Ahmad took the bizarre and deliberate propaganda of HM Treasury, made a film, and the whole story was widely reported on the BBC and across all media.

    Most ordinary people are not in the position of a George Osborne, able to summon up several new jobs after being made redundant. The threats of Osborne, the Treasury, and the government were very worrying indeed to normal voters and without doubt influenced many to vote Remain.

    Does Hammond think we have very short memories?

    The now ex-Chancellor Philip Hammond is now at it again, resurrecting Project Fear. This time it’s about leaving the EU on 31 October, “come what may, do or die,” in the words of our new Prime Minister Boris Johnson.

    As a result of Mr Hammond’s obstructive, anti-Brexit tactics over the last three years, it is likely that the UK will have a bumpy ride in the short-term when it leaves on 31 October. If this happens, we invite readers to remember that Mr Hammond was one of the most powerful men in the Government. And he was an integral part of the Government’s failure to deliver a true Brexit in three years.

    Perhaps blame should therefore be attached accordingly.

    Whilst the BBC reported the latest record-breaking employment figures, they failed to mention the increase in employment of 1.1 million people since the EU Referendum. The Brexit Facts4EU.Org team thought readers might want to know, given that Brexit is the no.1 news item at present.

    If the UK doesn’t ditch the Withdrawal Agreement we’ll be in the EU’s dock for decades to come

    Brexit Facts4EU.Org has analysed the EU Commission’s latest list of legal “infringements” against the United Kingdom up to the end of October. We only looked at the varying forms of legal action taken by the Commission since the UK ostensibly “left” the EU on 31 January 2020.

    • The UK’s official membership of the European Union ceased at 11pm on 31 Jan 2020
    • The EU has issued 46 legal moves against the United Kingdom since it “left” the EU, just nine months ago
    • 42 of these legal moves were for new cases, four were for advancing already existing legal action

    What is the unelected EU Commission attacking the UK for?

    The extent to which the EU Commission interferes in the legal sovereignty of the United Kingdom can be seen from the list of areas in which it has opened the legal processes.

    1. Employment, Social Affairs and Equal Opportunities
    2. Energy
    3. Environment
    4. Financial Stability, Financial Services and Capital Markets Union
    5. Health and Food Safety
    6. Home Affairs
    7. Internal Market, Industry, Entrepreneurship and SMEs

    10. Task Force for Relations with the United Kingdom

    All of these 46 actions have been taken by the EU Commission since the United Kingdom ceased to be a member state, at 11pm on Friday 31 January 2020. The information all comes from the EU Commission itself and we have used the EU’s description of the subject areas for the actions they have taken.

    Let’s remember the pro-EU lies we were all up against

    Back in 2014, when the move for an EU Referendum was gathering momentum, Deputy Prime Minister and LibDem leader Nick Clegg clashed with Nigel Farage in a televised debate hosted by LBC.

    Nick Clegg stated live on air that his source was the House of Commons Library for the 7% claim. Despite that august body (which MPs trust) being staffed by civil servants – a massive part of the public sector who are overwhelmingly pro-EU – even the HoC Library felt it necessary to issue a correction after listening to Mr Clegg.

    “The average over these four years was higher, at 59%. But even this calculation does not take account of UK primary legislation or EU ‘soft law’ such as statements, recommendations, guidelines, declarations, special reports etc, which may be implemented equally ‘softly’ in the UK.”

    In the year preceding Mr Clegg’s televised debate with Mr Farage (2013), the House of Commons Library’s estimate was actually 61.2%. And as they said, “even this calculation does not take account of UK primary legislation or EU ‘soft law’ such as statements, recommendations, guidelines, declarations, special reports etc.”

    Observations

    Remember Nick Clegg?

    During the EU Referendum campaign which started almost five years ago, we attacked former LibDem leader Nick Clegg for dismissing the legal supremacy which the EU had – and has – over the United Kingdom Parliament and courts.

    The research and analysis we have published above is but one snapshot of how wrong Mr Clegg was.

    And this snapshot does not show the tens of thousands of laws which the EU has imposed on the UK and which the UK has had to obey, with no debate in the UK Parliament, for decades.

    Mr Clegg is now the highly-paid spokesman for a US company which denies free speech and which unilaterally censors content of which it disapproves.

    ‘Taking back control’ should mean just that

    Unfortunately, thanks to the Withdrawal Agreement the British people will continue to be subject to the jurisdiction of the European Court of Justice, (effectively the supreme court of a foreign power), after the UK’s second ‘exit’ from the EU at the end of this year.

    When the Transition Period ends on 31 December 2020, the United Kingdom will still not be free, independent, and sovereign. The only way this will happen is if the United Kingdom rescinds the EU’s abominable Withdrawal Agreement, on the grounds of the EU’s serious and material breaches of it.

    Following the publication yesterday of “The Big Brexit Initiative”, a highly experienced politician and totemic signatory of the letter to the Prime Minister speaks out publicly.

    The indefatigable and plain-speaking former Minister of State and former MEP for the Brexit Party, the Rt Hon Ann Widdecombe, has written a hard-hitting article for Brexit Facts4EU.Org, spelling out some simple truths.

    A Sovereign State?

    A sovereign state owns its waters and all that in them is, so how can there be any question about the validity of Britain alone having the right to determine who fishes her seas and to what extent? The mere fact of any negotiation on this point indicates how little the EU has understood the reality of Brexit.

    As for there being any possibility of a level playing field, what do the negotiators imagine was the prime aim of Brexit in the first place?

    The single biggest benefit of no deal is that it will finally spell out to the EU that we have left for good and that we intend to operate as an independent country. Or will it? Is it possible both to be sovereign and to abide by the Withdrawal Agreement and its concomitant Political Declaration?

    The Internal Market Bill tests the validity of unilateral amendment but it is the whole treaty which needs repudiating. We left, so why did we ever need a new treaty as opposed to merely a trade agreement?

    There has been a great deal of argument about whether the Internal Market Bill breaks international law but that bill merely breaks clauses and sub clauses of the Agreement, which is to have one’s cake and eat it.

    There can be no argument at all that it is possible to repudiate an entire treaty. Countries have been doing it since the word treaty was invented. Certainly, it is harder these days with the Vienna Convention but it is still possible and that is what HMG should be doing.

    By ridding of us of the shackles of what has been rightly described as a surrender document, an agreement drawn up by a weak government against the background of the other party being determined to punish us for leaving, Boris could lead a truly independent Britain. Isn’t that what he wants?

  • EU announces plan for voluntary minimum wages – 22 years after UK set mandatory standard

    EU Commission’s proposed ‘Directive’ doesn’t even make this an EU legal requirement

    On workers’ rights, the EU still lags behind the UK by over 20 years

    On Wednesday (28 Oct 2020), the EU Commission announced that it will be bringing in a ‘Directive’ on minimum wages across the EU. They proclaimed this as follows:-

    “An EU Directive to ensure that the workers in the Union are protected by adequate minimum wages allowing for a decent living wherever they work.”

    But 22 years after the UK enforced a national minimum wage, the EU still proposes to make it voluntary

    Buried down in the EU Commission’s communication about this new Directive on Wednesday, following the warm words from Ursula von der Leyen and her Commissioners, was the following:

    “It does not oblige Member States to introduce statutory minimum wages,
    nor does it set a common minimum wage level.”

    In other words, 22 years after the UK led the way and introduced a national minimum wage in 1998, the EU will still not have one, and furthermore it will not compel member states to introduce one.

    Despite this, here are the EU Commissioners’ pronouncements last week

    President of the European Commission Ursula von der Leyen said:

    “Today’s proposal for adequate minimum wages is an important signal that also in crisis times, the dignity of work must be sacred. We have seen that for too many people, work no longer pays. Workers should have access to adequate minimum wages and a decent standard of living.

    Nicolas Schmit, Commissioner for Jobs and Social Rights, said:

    “Almost 10% of workers in the EU are living in poverty: this has to change. People who have a job should not be struggling to make ends meet. Minimum wages have to play catch up with other wages”

    EU workers’ and women’s rights laws are lower than UK’s

    • UK statutory paid holiday entitlement is 28 days, in EU only 20 days
    • National Minimum Wage Act 1998 – there’s no EU minimum wage law
    • Maternity leave – UK: 52 weeks, EU: 14 weeks
    • Under EU laws, the British people’s rights would decrease

    Observations

    For years Remainers have been claiming that workers’ rights are protected by the EU and will be decimated when the UK finally leaves the Transition Period in just over 60 days’ time.

    This was of course never remotely true, as Brexit Facts4EU.Org demonstrated by researching the facts and publishing them many times over the past four and a half years.

    The EU’s announcement on Wednesday was typical. Trumpeting something designed to appeal to the peoples of the EU member states, but in practice delivering almost nothing. The new Directive will not require Member States to introduce a statutory minimum wage and nor will it set a common minimum wage level.

    This new EU Directive will merely set out some aspirations. Sadly, for many poor people across the EU, aspirations do not pay bills.

    Had the UK stayed in the EU, the pull of a statutory minimum wage – as well as all the other benefits such as free healthcare – would still have drawn hundreds of thousands of people from poorer EU countries to come and live in the United Kingdom.

    If Japan can agree a trade deal with the UK in just three months

    why can’t the EU manage it in four-and-a-half years?

    World’s third & fifth largest economies sign historic agreement to launch Global Brexit Britain

    On Friday 23 Oct 2020, Liz Truss, Secretary of State for International Trade, flew to Tokyo and signed the UK’s first trade deal with a G7 country: Japan.  Named the UK–Japan Comprehensive Economic Partnership Agreement (CEPA) the Government describes this as:

    “The first deal that the UK has struck as an independent trading nation. A British-shaped deal that goes beyond the existing EU agreement, securing bespoke benefits for British businesses and citizens.”

    This deal also marks an important step towards joining the Comprehensive Trans-Pacific Partnership free trade area, which would result in closer ties with 11 Pacific countries which represent 13% of the global economy. This economic area is growing far faster than the EU.

    The deal rolls over the EU’s arrangements with Japan and betters them

    In the past the UK had to accept the priorities of the 27 other member countries of the EU when the EU Commission was conducting its very lengthy negotiations. The interests of some of these countries – many of which are tiny – were of course widely divergent from those of the United Kingdom.

    Now that the UK is negotiating on its own behalf it is able to tailor trade deals to the UK’s specific economic interests. As the Dept for International Trade states:

    “The deal is tailored to both economies and goes beyond existing EU deals, with big benefits for digital and data, financial services, food and drink, and creative industries.

    “The deal brings together two of the world’s most technologically advanced nations, placing the UK at the forefront of shaping new global standards on digital trade.”

    The path to the Pacific opens up for Global, Brexit Britain

    This trade agreement also includes a strong commitment from Japan to support the UK joining the ‘Comprehensive and Progressive Agreement for Trans-Pacific Partnership’ (CPTPP), one of the world’s biggest free trade areas.

    The countries who form part of the CPTPP are: Australia, Brunei, Canada, Chile, Japan, Malaysia, Mexico, New Zealand, Peru, Singapore, and Vietnam. Together they cover 13.4% of the global economy and more than £110bn of trade.  The agreement entered into force over the first two weeks of last year (2019) and the CPTPP is now the third-largest trading bloc in the world.

    The UK International Trade Secretary, Liz Truss

    On Friday in Tokyo, the Secretary for International Trade, the Rt Hon Liz Truss MP stated:

    “Today is a landmark moment for Britain. It shows what we can do as an independent trading nation, as we secure modern and bespoke provisions in areas like tech and services that are critical to the future of our country and the reshaping of our economy.”

    Observations

    This significant economic and political development for the post-Brexit United Kingdom which begins on 01 January 2021 received relatively scant media attention. Those articles which did appear were more inclined to be dismissive, or damned with faint praise.

    Let’s be clear about the basics

    • This trade deal with Japan was secured in a little over three months
    • The EEC/EU didn’t manage this for 60 years
    • It means a UK trade deal with the world’s third-largest economy
    • It opens the door into the Pacific markets for Global Brexit Britain
    • It improves on the EU’s arrangements and is tailored to British interests

    Remainers can scoff all they want. The deal with Japan can always be improved – this is in the nature of trade deals and it will happen. However this is a good deal right now which secures UK-Japan trade at the end of this year. The important thing is that this a huge shot in the arm for the country and it’s very welcome news.

    This deal really does beg the question. If Japan can roll over and improve its trading relationship with the UK for the post-Brexit world in just three months, how come the EU has proved incapable of this in four-and-a-half years?

    Finally, a small gripe. Whilst we understand Liz Truss wanting to sign in Tokyo in order to secure more coverage in the Pacific press, we would have insisted that the deal be signed in London. It might then have received more UK press coverage, thereby sending a positive message to the people of the United Kingdom about Brexit and would incidentally have sent a delicately-thumbed nose to the EU.

    We’ve said this many times before and we’ll say it again: Government communications in Whitehall continue to need a massive shake-up.

    And finally finally, readers who were hoping to read an article about rescinding the Withdrawal Agreement and what Brexit Facts4EU.Org is doing about this must be patient for another day. Our resources were insufficient to complete this. We hope to publish some exciting news tomorrow.

    Government set to break manifesto promises if Boris doesn’t call out EU on its breaches of WA

    Major new paper should strike alarm in No.10 – Brexit Facts4EU.Org summary

    On Sunday a major new paper was issued by the new Brexit think tank, the CBP, which states that the UK will not even be able to trade like Australia unless it rescinds the EU’s dictatorial Withdrawal Agreement.

    Co-written by former Conservative leader the Rt Hon Sir Iain Duncan Smith MP, Chairman of Lawyers for Britain Martin Howe QC, Professor of International Economic Law David Collins, and senior economist Edgar Miller, this new paper presents a chilling picture for the UK unless the Government acts now.

    The Rt Hon Sir Iain Duncan Smith MP, talking exclusively to Brexit Facts4EU.Org, said:

    “The ability for the UK to trade normally around the world after Brexit like, for example, Australia, must surely be a minimum expectation of the British public come the end of this year.

    “Our analysis shows that this can only happen if we deal with the serious deficiencies in the Withdrawal Agreement, if necessary rescinding it. Such action would be entirely reasonable on the grounds of the EU’s bad faith and breaches of it since January. We will then truly be able to benefit from the tremendous opportunites ahead for a free, independent, and sovereign United Kingdom.”

    Unless specific steps are taken to rescind the EU’s Withdrawal Agreement (WA), it will continue to apply to the UK for the long term with debilitating effects on our laws, freedom of action, and sovereignty – with or without a trade deal.

    • The UK will not even be able to trade “on Australian terms” unless the WA is rescinded or amended
    • The Conservatives’ manifesto commitments on Brexit will not be able to be honoured
    • Rescinding the WA must be done before 31 December 2020, or it will be too late

    Given the conclusions of this paper, the Government is left with only a single viable option – rejecting the Withdrawal Agreement (WA) and Northern Ireland Protocol (NIP) before 31 December.

    Is Boris about to tear up the manifesto commitments he made only 11 months ago?

    As the Centre for Brexit Policy say, “in the absence of an agreement between the UK and the EU, an ongoing presence of the Withdrawal Agreement and Northern Ireland Protocol would make it impossible for the Government to deliver its Manifesto Brexit commitments.”

    Page five of the Conservative Party’s 2019 Election Manifesto describes the commitments the Government undertook with regard to Brexit. Here’s what the now Government promised:-

    • Take the whole country out of the EU as one United Kingdom
    • Take us out of the EU’s Customs Union, allowing us to set our own tariffs and do our own trade deals
    • Will be a new relationship based on free trade and friendly cooperation, not on the EU’s treaties or EU law
    • There will be no political alignment with the EU
    • End the role of the European Court of Justice

    This future relationship will be one that allows us to:

    • Take back control of our laws, our money, our own trade policy
    • And ensure we are in full control of our fishing waters

    So what’s the problem?

    Unfortunately, as we, the CBP, and others have pointed out, with the WA and NIP (Northern Ireland Protocol) in place it would be impossible to have a normal World Trade Organisation (WTO) relationship with the EU, such as Australia enjoys.

    The simple reason is because the WA/NIP imposes EU state aid rules (which supersede WTO subsidies rules) and also imposes special customs/tariff procedures on part of the United Kingdom (Northern Ireland) which the WTO arrangement does not do. The EU’s Withdrawal Agreement also expressly excludes WTO dispute settlement procedures for these issues.

    The CBP say that: “The Government is ‘boxed in’ with no viable attractive options, as long as the WA/NIP remains in force. In addition to leaving the UK in a colonial-type relationship with the EU and being unable to realise many of the economic benefits afforded by a true Brexit, the Government could likely experience a strong backlash in the next election from those who provided its current 80 seat majority.”

    In other words if you don’t ditch the Withdrawal Agreement, Prime Minister, you’ll be breaking your manifesto promises on which you were elected.

    Deal or no deal – revealing the truth

    As we have reported many times, most members of the public and most MPs believe that whether the UK leaves the Transition Period at the end of this year with an EU trade deal or not, the UK will be free from the jurisdiction of the European Court of Justice (ECJ) and other EU controls on our laws and sovereignty. This is simply not the case.

    What is perhaps even worse is that the sovereignty of the United Kingdom will have been violated by the European Union in Brussels.

    The EU has divided the United Kingdom using the Withdrawal Agreement

    It seems quite extraordinary, but the EU has succeeded in using Brexit to divide the sovereign territory of the United Kingdom and to assume control of the laws of a significant part of it. Northern Ireland has been part of the UK since 1801, and had in fact been mostly under British control since the 16th century. With the EU’s Withdrawal Act, the EU has effectively split Northern Ireland off from the rest of the UK and taken control of much of its laws and regulations.

    Here’s what the CBP paper has to say:-

    • “NI must apply internally all EU single market laws on goods as they now stand and as they are changed by the EU in future; all laws will be under the direct jurisdiction of the EU Commission and ECJ
    • “There are consequent requirements for EU mandated regulatory controls on goods imported into NI from GB to ensure conformity with EU single market rules, even where the goods are not at risk of moving on into EU”
    • “NI will be subject to EU customs control procedures and to EU VAT rules”
    • “NI will be subject to direct EU State aid control by the EU Commission”
    • “aid to businesses in the whole of the UK [will be] subject to [EU] State aid control”

    How on earth did we let the EU take our territory without firing a shot in defence?

    This has happened because of the disastrous tenure of No.10 by Theresa May from 2016-2019, who led a Remainer, EU-appeaser UK Government backed by a Remainer House of Commons of MPs from the Conservative, Labour, SNP, LibDem, Plaid Cymru and Green parties.

    With the backing of MPs who were opposed to the will of the British people expressed in the largest vote in UK history, Mrs May and her Remainer civil servants willingly went along with the EU in its efforts to punish the British people.

    We believe that the unelected eurocrats in Brussels never thought they would actually sever Northern Ireland as they have. It is our belief that they saw the N.I. Protocol as being such an appalling instrument that the UK Parliament would somehow ensure that the EU Referendum result would be overturned.

    It was only the obstinacy, politicking, and poor strategy of the Remainer MPs which led to May’s version of the Withdrawal Agreement being voted down three times in the House of Commons. This then led to a Conservative leadership election and the ultimate election of Boris Johnson as Prime Minister in December 2019.

    Observations

    The CBP has written another compelling document which defines the EU’s imposed, subservient, colony status of the United Kingdom from 31 December 2020, as the UK attempts to spread its wings in the world again.

    It really is now time for the Prime Minister and the Government to realise that the British people are not going to be fooled by a fudged trade deal and a Withdrawal Agreement which siphons off part of the sovereign territory of the UK, and imposes EU law on the rest of the UK for generations to come.

    We have continuously argued since before the EU Referendum, from deep research of official facts, that the EU has been determined to punish the British people from the moment the EU Referendum result was announced. We further argued that the United Kingdom would never end up with any kind of reasonable deal because the EU would not offer one.

    This latest report from the new ‘Centre for Brexit Policy’ is yet another proof that our work and our conclusions over the years were not wrong.

    12 Brexit organisations urge the scrapping of the Withdrawal Treaty

    In a letter to Boris Johnson, Brexit Facts4EU.Org writes for wide Brexit thinking

    On Friday, the Prime Minister made a televised statement and No.10 then declared that “the trade talks are over”. Today, Sunday 18 October 2020, Brexit Facts4EU.Org is leading a campaign of 12 Brexit organisations who are urging the Prime Minister to “complete the job”.

    The 12 Brexit organisations and 10 influential individuals who have signed the letter to the PM have done so because it is now essential to rescind the Withdrawal Agreement (WA).

    The reasons are simple

    When the UK exercised its right to leave the European Union, it participated in the WA process on the basis of an essential condition: the EU would act in good faith to agree a future permanent arrangement that enshrines UK sovereignty and secures a Free Trade Agreement.

    It is now clear that the EU has breached its obligations repeatedly and consistently.

    The representatives of a broad range of Brexit thinking now urge the PM to act

    Prime Minister, you have robustly declared that the EU seems uninterested in a normal trade deal. In this event, we urge you to:

    1. Announce that the Withdrawal Agreement and Protocol shall no longer have any legal force, with effect from 1st January 2021.
    2. Implement alternative arrangements for the north-south border on the island of Ireland within the framework of the Good Friday Agreement, from the end of 2020, to ensure there is no need for the British government to impose a hard border.
    3. Cease to make payments to the EU under the WA provisions.
    4. Demand the UK’s proper share of the European Investment Bank.
    5. Unilaterally grant favourable treatment to EU citizens resident in the UK in a manner consistent with the UK’s legal framework

    To reiterate:

    The United Kingdom Government must now rescind and void the Withdrawal Agreement on the basis of the breach by the European Union. Anything else would be a betrayal of democracy, sovereignty, and international law.

    Observations

    The 12 Brexit organisations who have co-signed our letter today to Boris Johnson represent a wide range of Brexit thinking and a very large number of voters.

    This issue is serious. Putting aside the rights and wrongs of whether the UK Government should ever have signed the abominable Withdrawal Agreement, it’s now perfectly clear that the EU have not honoured it. The Government must therefore now rescind and void it forthwith.

    In our view, and in the view of the 11 other Brexit groups, as well as the view of the Centre for Brexit Policy (who could not sign as they are “not a campaigning organisation”), it is essential that the WA must be voided before 31 December 2020.

    If this does not happen, the United Kingdom will continue to be under the yoke of the EU for decades to come.

    Mr Johnson, please act now, and finish the job

  • Current UK Government policy is not to deliver Brexit

    What’s the likelihood of British people being presented with a sickly-sweet Brexit fudge?

    Are we heading for a “soft, sweet, crumbly substance made from a sugar and dairy mix”?

    If readers are expecting the United Kingdom to become a free, independent and sovereign country at the end of this year they are going to be sorely disappointed.

    Current UK Government policy is not to deliver this.

    It almost does not matter what happens in the off-on, on-off trade talks between the UK and the EU – a possible trade deal is only half the story. And a trade deal with the EU is not Brexit, it is what the words imply: a trading arrangement. On this we expect a grand fudge – “a soft, sweet, crumbly substance” – in the coming weeks, but in some ways this hardly matters.

    Any absence of a trade deal is, however, highly relevant to extricating the UK from its current BRINO Brexit, as we shall explain.

    Brexit isn’t trade. Brexit means a fully free, independent and sovereign country

    The current nature of Brexit is embodied in the Withdrawal Agreement and Political Declaration. This abomination was drawn up by the EU and agreed by the disastrous Remainer Government of Theresa May. The Withdrawal Agreement (WA) was subsequently signed with just one amendment by Boris Johnson on 24 January this year.

    The Political Declaration (PD) contained some small amendments – just enough for Nigel Farage to stand down half his Brexit Party candidates at the election. The WA and PD came into force at 11pm UK time on 31 January 2020.

    This Withdrawal Agreement splits the United Kingdom, leaves it subject to EU law for generations to come, and involves a divorce bill so outrageous that neither the EU nor UK Government will currently admit how large it is.

    Brexit Facts4EU.Org attacked this abomination the day after it was first published by the May Government back in 2018.

    We have attacked it consistently ever since, in articles far too numerous to mention.

    We further attacked the Withdrawal Agreement after Boris Johnson secured just one change – to the Northern Ireland Protocol – and we have published detailed research and legal arguments on it throughout this year.

    So why is it that the British people do not know they will be an EU colony on 31 December 2020?

    The fact that the majority of the British public are unaware of what the legal status of their own country will be after 31 December – when we are supposed to be finally free of the EU’s shackles – is down to many factors. Here are three key ones.

    1. Boris and politics

    Firstly, Boris Johnson was facing a Remainer-dominated Parliament when he negotiated a revision to the Withdrawal Agreement with the EU. This had to be done at speed because of a personal promise he made to deliver Brexit by 31 October 2019 “or die in a ditch”. It was, in effect, a rush job that he hoped to get through Parliament. He failed, so he went to the country in December and secured a massive majority.

    The problem he then faced was that just because he had a more balanced Parliament this did not mean that he could call out the Withdrawal Agreement as a dog’s dinner, because he himself had advocated it so strongly. And so he signed it in January.

    2. The media and institutions

    The three main broadcast channels – the BBC, Sky News, and ITN are all pro-Remain. The majority of the print media are all pro-Remain. The Express, parts of the Sun, and parts of the Telegraph are the exceptions. The country’s main institutions are pro-Remain, up to and including the Church of England (for heaven’s sake).

    The British public has therefore been subject to a bombardment of Establishment propaganda which started before the EU Referendum and has continued ever since. The Establishment – insofar as it finally had to accept that Brexit was happening, wanted the closest alignment possible with Brussels. This is what the Withdrawal Agreement and Political Declaration delivers, so they were therefore not about to call it out for what it is.

    3. COVID

    It is a simple fact that our news has been dominated by the COVID crisis from just four weeks after the UK ostensibly left the EU on 31 January. Dominated is perhaps the wrong word. The news has been saturated in Coronavirus.

    There were periods when Brexit – the most significant change to the United Kingdom’s constitutional status in almost two generations – barely got a look in. This is a shocking abrogation by the broadcast media over the past eight months, who no longer seem able to report on more than one topic.

    Here is why the trade agreement is relevant to a true Brexit

    The Withdrawal Agreement and Political Declaration, which define the nature of Brexit as we have explained, were predicated on the EU acting in good faith in the prompt negotiation of a trade deal with the UK.

    The EU has patently failed to use its best endeavours in fulfilling this obligation and is therefore in material breach of the Agreement. This gives the right to the UK Government to rescind the Agreement and it must do so before 31 December 2020.

    We have set out all the legal arguments in previous articles, many of them prepared with the advice of top legal experts. In our next article we will summarise all of these for readers, MPs, and for the Government.

    The Government ignores the WA and PD and resumes trade talks immediately with the EU

    Instead of rescinding the Withdrawal Agreement and Political Declaration, the Government announced yesterday that intensive talks are to resume immediately, seven day-a-week.

    In a statement released yesterday afternoon, the Government said:

    “We have studied carefully the statement by Michel Barnier to the European Parliament this morning. As the EU’s Chief Negotiator his words are authoritative.

    “The Prime Minister and Michael Gove have both made clear in recent days that a fundamental change in approach was needed from the EU from that shown in recent weeks. They made clear that the EU had to be serious about talking intensively, on all issues, and bringing the negotiation to a conclusion. They were also clear that the EU had to accept once again that it was dealing with an independent and sovereign country and that any agreement would need to be consistent with that status.

    “We welcome the fact that Mr Barnier acknowledged both points this morning, and additionally that movement would be needed from both sides in the talks if agreement was to be reached.”

    We wonder if the Government read our analysis yesterday of the speech given before Monsieur Barnier’s, by EU Council President Charles Michel at the EU Parliament in the morning? President Michel’s speech contradicts that of Monsieur Barnier and gives no cause for optimism that the EU will move far from its red lines, which it most definitely needs to do.

    The President of the EU Council of the 27 leaders of the EU most certainly outranks Monsieur Barnier, so we find the UK Government’s assertion that “As the EU’s Chief Negotiator his words are authoritative” to be rather strange. We assume these words were added because the Government had also read the speech by the EU Council President, and were aware of the contradictions.

    If Boris Johnson wants to be remembered for delivering Brexit, he must complete the job now

    • There must be no fudged Brexit trade deal compromising the UK’s sovereignty and independence
    • The Prime Minister must announce that in the light of the EU’s serious and continuing breaches, the WA is rescinded
    • A full-on information campaign for public and world opinion must be launched
    • The Government must move all Brexit resources to preparing for a no deal Brexit on 31 December 2020
    • Side deals on many related Brexit ‘continuity’ matters, already agreed with the EU, should now be signed

    It is the Withdrawal Agreement and Political Declaration which prevent the achievement of a fully free, independent, and sovereign United Kingdom. These must now be voided by the Government so that the UK can move on to the Brexit opportunities ahead of us all.

    Observations

    Brexit Facts4EU.Org has always been a party-neutral organisation and we remain so. Where we criticise Government policies and actions, our criticisms relate to the handling of the Brexit process. Furthermore, we do not consider that the policies of the Opposition would have been any better. In fact we are sure they would have been infinitely worse.

    Sadly we have arrived at the point where we believe a classic fudge will be offered to the country, dressed up in pretty packaging much as would be seen in a seaside gift shop.

    There is no sign that the Government intends to release us from being under the control of the EU from 31 December. To achieve this they would have to rescind the abominable WA and PD, and this is not even being discussed. In addition it looks highly probable that any trade deal will continue to include clauses which no other country would accept from the EU.

    We are doing what we can

    Brexit Facts4EU.Org is currently working to persuade all the other major Brexit organisations to participate in a definitive message to the Government and to all MPs – particularly those in the ERG who have the power to play a significant role in influencing events.

    The message will be simple and we hope it is one that absolutely all pro-Brexit groups and individuals can support.

    If we all want to see a free, independent, and sovereign United Kingdom on 01 January 2021, then the Government must act now to rescind the Withdrawal Agreement and Political Declaration. This is the only sure way to achieve a true Brexit.

  • “Trade talks are over,” says no.10, but where’s the statement revoking the Withdrawal Treaty?

    The EU is now in de facto breach of the Withdrawal Treaty, which must be repudiated immediately

    Full text of the PM’s statement, comments from No.10, and our Brexit Facts4EU.Org analysis

    Below is the Prime Minister’s official statement on the temporary halt to the trade talks with the EU, together with a “No, it’s business as usual” response from Brussels.

    The Prime Minister’s official spokesman enlarged on and clarified the statement, telling journalists:

    “There is only any point in Michel Barnier coming to London next week if he’s prepared to address all the issues on the basis of a legal text in an accelerated way, without the UK required to make all the moves or to discuss the practicalities of travel and haulage.”

    “If not there is no point in coming.”

    “Trade talks are over. The EU have effectively ended them by saying they do not want to change their negotiating position.”

    Here is the full text of the statement by the Rt Hon Boris Johnson MP on 16 October 2020

    “Good morning,

    “We left the EU on January 31 and delivered on the largest democratic mandate in the history of this country.

    “And since then we have been in a transition period obeying EU law, paying our fees – as a non-voting member – working on the future relationship we hope to enjoy with our friends and partners from January.

    “And from the outset we were totally clear that we wanted nothing more complicated than a Canada-style relationship, based on friendship and free trade.

    “To judge by the latest EU summit in Brussels that won’t work for our EU partners. They want the continued ability to control our legislative freedom, our fisheries, in a way that is obviously unacceptable to an independent country.

    “And since we have only ten weeks until the end of the transition period on January 1, I have to make a judgment about the likely outcome and to get us all ready.

    “And given that they have refused to negotiate seriously for much of the last few months, and given that this summit appears explicitly to rule out a Canada-style deal, I have concluded that we should get ready for January 1 with arrangements that are more like Australia’s based on simple principles of global free trade.

    “And we can do it, because we always knew that there would be change on January 1 whatever type of relationship we had. And so now is the time for our businesses to get ready, and for hauliers to get ready, and for travellers to get ready.

    “And of course we are willing to discuss the practicalities with our friends where a lot of progress has already been made, by the way, on such issues as social security, and aviation, nuclear cooperation and so on.

    “But for whatever reason it is clear from the summit that after 45 years of membership they are not willing – unless there is some fundamental change of approach – to offer this country the same terms as Canada.

    “And so with high hearts and complete confidence we will prepare to embrace the alternative. And we will prosper mightily as an independent free trading nation, controlling our own borders, our fisheries, and setting our own laws.

    “And in the meantime the government will be focussing on tackling COVID and building back better so that 2021 is a year of recovery and renewal. Thank you very much.”

    Meanwhile in Brussels it was as if nothing had happened

    Yesterday afternoon, in response to the statements from No.10, the EU Commission President Ursula von der Leyen tweeted a “No, it’s business as usual” message.

    So, on the one hand No.10 says there’s no point Monsieur Barnier travelling to London next week, and on the other hand it seems he will be doing just that.

    According to a spokesperson from No.10 yesterday evening, Lord Frost spoke to Michel Barnier by phone: “Lord Frost said that, as the PM had made clear, the European Council’s conclusions yesterday had left us without a basis to continue the trade talks without a fundamental change in the EU’s approach to these negotiations. There was accordingly no basis for negotiations in London as of Monday.

    Observations

    It must always be remembered that the EU is desperate for the UK to be seen as the party at fault. The PM has to sound reasonable, for those around the world who are watching, and his statement must be viewed in this light.

    The words from the PM’s official spokesman were for us more encouraging than those uttered by Boris Johnson himself.

    “Trade talks are over. The EU have effectively ended them by saying they do not want to change their negotiating position.”

    The problem is with what happens next, and unfortunately there are as yet no signs that the UK Government will go nearly far enough.

    There are two huge challenges, not one

    There are in fact two absolutely fundamental elements to the UK’s future relationship with the EU

    1. A ‘SuperCanada’ UK-EU trade deal, and
    2. The repudiation of the Withdrawal Treaty

    The first is clearly now unattainable in our view. However the most fundamental element that has not yet been mentioned by No.10 is the second of these fundamentals. With the PM effectively declaring yesterday that the EU has shown no serious intent to establish a normal trade deal with the UK, this puts the EU in de facto breach of the Withdrawal Treaty.

    The EU aren’t stupid

    It was instructive that the President of the EU Council’s first tweet about their discussions contained this:

    “Withdrawal agreement has to be fully implemented. Full stop.”

    The EU are not stupid. They know that the Withdrawal Treaty turns the UK into a colony of the EU for decades to come.

    There must be a total repudiation of the Withdrawal Treaty, on the basis that the EU entered into it in bad faith and has failed to observe its basic premise of the requirement to put in place a normal trade agreement with the UK.

    If the Prime Minister is serious about trade talks being over,
    what better time than to announce that the Withdrawal Treaty is null and void?
    Once again we urge the Prime Minister most strongly to announce this essential move.

    If he does so this weekend, this would still allow time for the dust to settle and for a series of side agreements with the EU to be agreed quietly, to ensure a reasonable form of continuity after 31 December 2020 on matters such as travel, haulage, security, etc.
