  • The traditional British banger and the EU’s mash-up of food safety regulations

    With the drop in the EU’s food safety rules, are their claims to protect us just porky pies?

    Forget chlorinated chicken, new EU rules mean feeding us “abscesses, pus and TB material”

    Every year around eight million pigs are slaughtered for meat in the UK. The UK also imports pork meat from other EU countries. Meat from pigs’ heads is recovered by specialised boning plants and goes into pies, sausages and other processed foods. Millions of us consume this meat many times each year.

    If the EU wants to portray itself as a responsible regulator of food safety standards, it might be thought that they would be strengthening food safety regulations in order to protect the public, not rowing back on them. Not so, according to the European Working Community for Food Inspection and Consumer Protection (EFWFC) which represents the EU’s meat inspectors.

    “Consumers are being exposed to an “avoidable risk” of disease after a reduction of official controls in food inspections of pig and poultry carcasses across the EU. Diseased meat is being eaten by consumers in the UK and EU, including pus from abscesses and tuberculosis lesions from pigs’ heads.”

    The EU has lowered its food safety requirements

    The EU introduced new measures for checking pigs entering the food chain. This reduced the requirement for checking pig meat from a thorough inspection to a visual-only inspection, and this was warned about back in 2014.

    A visual-only inspection misses underlying diseases. In the words of Ron Spellman, the Deputy Secretary of the European Working Community for Food Inspection and Consumer Protection (EFWFC) which represents EU meat inspectors:-

    “Inspectors stopped cutting lymph nodes in pigs’ heads, which are known to contain abscesses and tuberculosis lesions. Under previous systems, the pigs’ head would have been rejected for food, but now the meat is minced to make sausages and meat pies, spreading the pus from the abscesses and TB material throughout these products.”

    “I don’t think you can prove it’s safe to feed people abscesses, pus and TB material.”

    Mr Spellman is also a member of the UK’s Association of Meat Inspectors, and he has been warning about the EU’s lowering of food safety standards for many years. In June 2014 Mr Spellman told the BBC: “Last year we know that there were at least 37,000 pigs’ heads with abscesses or tuberculosis lesions in lymph nodes in the head. They won’t be cut now. There’s no way to see those little abscesses, little tuberculosis lesions, without cutting those lymph nodes.”

    Mr Spelman also speculated on the reasons for the EU’s reduction in its food safety requirements: “These changes are motivated not by science or a desire to protect the consumer but are politically motivated to give the meat industry what they want: the reductions and eventual removal of official independent meat inspection.”

    The size of the problem

    We looked at the Food Standards Agency’s (FSA) report from January of this year. Here is what they said about ‘foodborne diseases’ – what most people would call ‘food poisoning’:-

    “We estimate that there were 2.4 million cases of foodborne disease in the UK in 2018, with 222,000 GP presentations and 16,400 hospital admissions.”

    By any measure this effect on public health from ‘foodborne diseases’ is highly significant.

    So what does the EU Commission have to say about all of this?

    The EU Commission’s justification for the reduction in meat inspections is that the cutting up of pig carcasses as part of meat inspections increases the risk of harmful bacteria spreading onto meat.

    A spokesperson for the European commission said: “The European Union retains some of the highest food safety standards in the world – this is a key priority. This is why the European Food Safety Authority provides expert scientific advice and recommendations while national authorities are responsible to carry out inspections in accordance with the official controls legislation.

    “Any meat with lesions indicating an animal disease such as TB, or abscesses, or any pathological or organoleptic changes, must be considered as unfit for human consumption and not be placed on the market.”

    The meat inspectors would doubtless agree with these worthy sentiments. However the problem as they see it is that the EU has reduced its safety requirements and ordered visual-only inspections of pigs. As Mr Spellman of the European Working Community for Food Inspection and Consumer Protection says: “There’s no way to see those little abscesses, little tuberculosis lesions, without cutting those lymph nodes.”

    Observations

    The EU constantly claims to be the originator of consumers’ and workers’ rights. British Remainers still to this day make these claims, despite all evidence to the contrary. (See our one-pager on this here.)

    In the case of food safety standards above we have shown how yet again the EU claims one thing and does another.

    “You are what you eat”, as the saying goes. If that is the case then we are now worried about all the barbecued pork sausages we consumed over the summer. And we will never look at a pork pie in quite the same way again.

    Help is at hand, and it’s called Brexit

    Under the disastrous Withdrawal Agreement and its Transition Period, the UK is still bound by the EU’s rules on food safety. If we had wished to restore the previous rules where our meat inspectors could do more than a visual inspection of a pig which might be infected, we could not have done so.

    From 01 January 2021, however, we can set our own rules. Currently most EU regulations are due to be reimposed as national laws by the UK Parliament, in order to ensure some continuity. We very much hope that most of these will be amended as quickly as possible to reflect the needs and wishes of the British people.

    The “never-in-good-faith-for-years-EU” now claims the UK has not acted in good faith

    At 10am this morning, 01 Oct 2020, the German President of the EU Commission made a short statement in Brussels, announcing that the EU will pursue legal action against the United Kingdom. UK-EU trade talks were carrying on while the German EU Commission President made her statement

    Below we present all the available documents so far from the EU about their hostile act this morning in threatening legal action against the UK Government, without the EU ever having demonstrated good faith in their ongoing negotiations with the UK.

    But what about the EU’s bad faith?

    Facts4EU.Org have already published many reports on the EU acting in bad faith ever since the British people voted to leave the European Union.

    Here are some very recent ones, which we strongly recommend once again that the UK Government read and act upon.

    Observations

    In the words of a top EU legal expert to us this morning:

    “The EU has moved too early, before the end of transition how can the EU know if it is us or them that has failed to conclude a deal? How can debating something in a democratic parliament be a breach of a treaty? What about UN rights to self-determination? There can be no better evidence that the Withdrawal Agreement is an affront to democracy.

    “The EU move is more evidence of bad faith – using a possible but not yet actioned breach as a pretext for legal action timed for the purposes of maximum negotiating impact.”

    We concur with this barrister. The idea of the EU bringing an action against the UK for acting in bad faith is almost laughable, in our opinion. In the four plus years of negotiations with the European Union the United Kingdom has experienced almost nothing other than bad faith from the EU’s federalist zealots.

    The EU wrongly seizes the high ground again

    For years we have been trying to get the basics through to the UK Government – Mr Cameron’s, then Mrs May’s, and then Boris Johnson’s. When WILL they ever listen?

    The EU does not act rationally, nor as a friendly partner. Especially since the British people voted to leave the EU over four years ago. Does the world know this? No, they do not.

    We must now increase the pressure on the UK Government to repudiate the Withdrawal Treaty in its entirety, to explain over and again what the UK has been through with the EU, and to call the EU out as having acted in bad faith for years.

  • Will the EU come bleating when they realise they’ve lost over ¼ of their sheep?

    Latest report from the EU shows importance of UK farming sector

    Due to Brexit the EU has lost 23m of its sheep and 10m of its cows

    The EU’s official statistics agency (Eurostat) has published a report on livestock, effectively showing where its meat and dairy products are produced. The vast majority of the data used by Eurostat last week comes from 2015, when the UK was still a full member of the European Union, but the figures have not changed much.

    Brexit Facts4EU.Org has therefore reviewed this data, reinserted the UK into the figures, and we can summarise the EU’s findings below.

    • In total, 19% of all EU sheep and cattle were British

    Observations

    Do Eudroids Dream of Electric Sheep?

    With apologies to Philip K Dick, author of “Do Androids Dream of Electric Sheep?” which was later made into the highly acclaimed film ‘Bladerunner’, we must ask the question “What about Eudroids?”

    With the departure of the United Kingdom from the EU monolith, over 23 million British sheep regained their nationality. The even better news for these sheep – if the UK Government so legislates – is that they will no longer be subject to the torture of a very long journey crammed in on an EU27 truck, only to be killed in an EU country on finally reaching their destination.

    Over one-quarter of all sheep in the EU were British, and one might assume that these animals are now very happy not to be part of the EU, with its livestock policies.

  • One disease kills over half a million in the EU each year – and it’s not COVID

    Today the EU marks International Heart Day – we bring you the official Brexit facts

    Heart disease kills almost three times as many EU & UK citizens as COVID

    The EU has just published a report to mark International Heart Day today, 29 Sept 2020.

    The latest data which has been published by the EU shows figures for 2016 and includes the United Kingdom. Among the 4.5 million deaths reported in the European Union in 2016, more than half a million were due to coronary diseases, including heart attacks.

    • And heart disease is only the third most common cause of death

    Where does the UK sit? The facts on heart disease across the EU

    At EU level, the standardised rate of deaths from coronary heart diseases stood at 1,194 deaths per million inhabitants in 2016. Men were almost twice as likely to die from coronary heart diseases as women, with 1,625 deaths per million for men compared to 881 deaths per million for women.

    The likelihood of dying from heart disease varies dramatically across the EU. (We have shown the UK as it was still a member state in 2016.)

    Observations

    Heart disease is not the main killer in the EU and UK. In fact it’s the third most common cause of death, after cancer and dementia. COVID-19 is of course way down the list, as we have previously reported.

    Nevertheless, it is International Heart Day and the EU have marked this. We felt it only right to do the same, but felt that readers might like to see a comparison with COVID-19.

    In these troubled times facts are important for the public. Sadly the ‘facts’ from the likes of Sir Patrick Vallance and Professor Chris Whitty at this week’s press conference were lamentable, to say the least. Their absurd conjecture of an exponential explosion in COVID has already proved to be nonsense, with ‘case’ numbers dropping ever since they made their announcement.

  • Want six new taxes? Vote for the EU. (Otherwise thank goodness for Brexit)

    EU Parliament plans for new EU taxes from 01 January, and for all rebates to be abolished

    Without Brexit, the UK economy would have been hammered under the latest plans

    Yesterday the EU Parliament summarised its position on new and additional funding for the EU. It involves the introduction of six new EU-level taxes, as well as removing the rebates enjoyed by some countries. If the UK were still a full member of the EU this would have resulted in an increase of some 50% in the UK’s annual contributions to the EU.

    These proposals were all originally made prior to the COVID crisis, but the plans are now being justified as being a solution to the massive need for funding as a result of the EU’s new financial mechanisms to deal with these commitments.

    The EU Parliament’s grab for more money for the EU

    1. January 2021: a new tax on member countries based on non-recycled plastic
    2. January 2021: a new tax on member countries based on the Emissions Trading System (a ‘carbon tax’)
    3. January 2023: a new digital services tax on internet-based businesses
    4. January 2023: a new carbon tax on imports of goods from outside the EU
    5. January 2024: a new financial transactions tax
    6. January 2026: a new EU corporate tax on companies

    Taxes go up and rebates get abolished

    Finally, there is a complete removal of the rebates on contributions enjoyed by some countries. Last year the UK’s rebate was £4.5bn, so the UK’s net contributions to the EU would rise by approximately this level if the UK were still a member.

    “MEPs also insist on the abolition of all rebates.”

    In 2019 according to HM Treasury and the House of Commons Library, the UK’s net contribution to the EU was £9.44bn. In fact it was higher, as a result of the “off-budget” payments to the EU which never appear in their summaries. Nevertheless we have shown that the official figure would rise by 48% to £13.96bn without the UK’s rebate.

    The costs of being a member of the EU would rise significantly under the EU Parliament’s plans

    The EU Parliament has couched the new taxes in ways which disguise the fact that member countries and their citizens will end up paying more. Under the above measures, the cost of doing business in the EU will rise. Ultimately this has a direct effect on all citizens.

    Here is an example of how these things are expressed in the EU Parliament’s legislative resolution of 16 September 2020 on the draft Council decision on the system of own resources of the European Union (10025/2020 – C9-0215/2020 – 2018/0135(CNS)) :-

    “such costs should be covered entirely by income from genuine new own resources”

    To describe these new taxation revenue streams as “genuine new own resources” appears to come from the ‘money grows on (carbon-neutral) trees’ school of thinking.

    The EU is not only spending, it is now having to borrow for the first time

    The EU Parliament’s legislative resolution also gives permission for the EU Commission to borrow on the world markets for the first time, thereby setting a dangerous precedent. Here is the opening statement:-

    “(1a) This Decision provides the legal basis for the Commission to borrow funds on the capital markets in order to finance expenditure in the framework of the Next Generation EU Recovery Package.”

    Observations

    When most prudent households find themselves in difficult economic times they tighten their belts. Not so the EU.

    Four years ago when faced with a large shortfall in income as a result of losing the UK’s annual contribution, did the EU scale back on its expenditures? No, it just kept on spending. The EU then simply came up with the idea of a “Divorce Bill” which was shockingly agreed to by Theresa May and her government.

    Today, faced with the double whammy of the loss of the “Bank of the UK” and the astronomical costs of the EU’s COVID measures, the EU Parliament’s solution is to tax more widely and deeply.

    The EU Parliament is not, of course, the ultimate decision-maker. These things involve the EU Council and the EU Commission too. All we can say is that the Commission always wants to extend its reach and the globalist leaders of most of the EU member states believe in the gradual creation of a superstate of ‘Europe’.

    All non-EU countries – including the UK – will be hit by the EU Parliament’s plans

    Thanks to Brexit, the UK will not be facing a huge increase in its annual contribution for future years of membership of this sclerotic organisation. This would have happened – without Brexit – if the EU abolishes all rebates, as we have shown in our chart above.

    Instead the UK taxpayer will merely be paying out huge sums which have no basis in international law for the EU’s contrived “Divorce Bill”.

    That said, some of the new taxes described above will affect British companies who wish to trade with the EU, as well as those from other countries around the world. Taxes 3, 4, and 5 in our list above will almost certainly affect non-EU businesses.

    Remainers never said what type of EU we would be remaining in

    It’s important when reading a report such as the one above to state that the British public did actually vote for Brexit and we will be leaving. The Remain side have been fond of saying “Yes, but no-one ever voted for a particular type of Brexit.” However – and as we pointed out many times during the debate – no-one on the Remain side ever admitted that no-one knew what voting Remain would mean. What type of EU would we remain in? Our report clearly shows one very expensive example of this.

    The Brexit bonus

    One way or the other Great Britain will finally be leaving the Customs Union and Single Market on 31 December 2020. Very sadly we will be leaving Northern Ireland behind, as things currently stand. We don’t yet know the precise terms of our departure, and we can only and sincerely hope that the Government will remain resolute and true to their words. If they don’t they will not be forgiven by a great many millions of voters.

    To quote the Rt Hon the Baroness Thatcher from a different era, 32 years ago:

    “We have not successfully rolled back the frontiers of the state in Britain, only to see them reimposed at a European level, with a European super-state exercising a new dominance from Brussels.”

    This threat remains, if the Government does not repudiate the Withdrawal Treaty before the end of this year.

    The upside is that the EU seems to be very busy, continuing to make itself less and less attractive as a place to do business. This presents great opportunities for an independent, democratic, sovereign, and free trade-loving United Kingdom to reap the rewards.

    It is essential that the Government does not compromise in the coming weeks. This is why we continue to fight.

    The debate in the UK right now is all about whether the Government will be breaking international law with its Internal Markets Bill. No-one is mentioning that international law is being broken on a daily basis by the draconian measures to control the Coronavirus by EU and other governments.

    International law is being broken everywhere, on a grand scale

    International human rights law lays down the obligations of governments to act in certain ways or to refrain from certain acts, in order to promote and protect human rights and fundamental freedoms of individuals or groups. The foundations of this body of law are in the United Nations Universal Declaration of Human Rights, adopted by the General Assembly in 1948.

    Here are just some of the rights embedded in international law:

    • The right to life and liberty
    • The right to freedom of opinion and expression
    • The right to work in just and favourable conditions
    • The right to education
    • The right to social protection
    • The right to the highest attainable standards of physical and mental well-being

    We would argue that almost every country in the world is breaking international law by the measures being imposed on populations by national governments.

    Observations

    The response to COVID should be about proportionality

    The latest figures from the ONS, released yesterday, show that you are 100 times more likely to die of non-COVID related causes than from dying “with” (not of) COVID.

    Children are more likely to die from being run over and then also being struck by lightning, than they are of dying from the Coronavirus.

    The number of infections is what the Government and the media report. We suggest that the first headline figures should be :-

    • The number of deaths “with COVID”
    • This number as a percentage of deaths from all causes
    • The number of hospital admissions “with COVID”
    • This number as a percentage of the 5-year average of hospital admissions from all causes

    Then the public would finally get a sense of perspective.

    It’s time for a “Rule of the Sick”, not a “Rule of Six”

    The most prolific life-threatening illnesses are cancer, dementia, and heart disease. Covid is now so far down on the list of killer diseases as to be considered ‘minor’.

    With so many hospital beds empty and the number of appointments for cancer, heart disease, and other serious conditions at an historic low, is it not time for the Government to promote a “Rule of the Sick” to prioritise these people and give them hope?

    Finally, what kind of country do we want to live in?

    Members of our team visited or lived in some former Communist states. One of the more extreme examples was Frau Angela Merkel’s country – the former East Germany – where the Stasi secret police inculcated an atmosphere of fear and established an enormous network of informers spying on their neighbours.

    Is this really what we want for the United Kingdom – the world’s cradle of freedom and democracy – in 2020?

    6.3 MILLION asylum applications from migrants to the EU27 in the last 10 years

    “You will take in the migrants according to our rules,” says the EU Commission

    Yesterday the EU Commission announced a plan of common rules for Member States. Despite measures by EU countries to prevent people from entering due to COVID restrictions, the latest official EU figures show that more than 275,000 asylum applications from migrants have been made so far this year.

    • 6,324,295 in the last 10 years
    • That’s equivalent to DOUBLE the populations of Newcastle, Sheffield, Liverpool, and Leeds – COMBINED
    • 4,505,680 of these have happened in just the last five years
    • Despite COVID restrictions 275,435 asylum applications have been made so far this year
    • All the above figures relate only to asylum applications – not to all who have entered the EU

    Failed asylum seekers – return rates

    Among the nationalities with at least 5,000 return orders, the return rate was particularly low for those coming from:

    • Democratic Republic of the Congo (2.5%)
    • Syria (2.5%)
    • Mali (2.8%)
    • Guinea (2.8%)
    • Côte d’Ivoire (3.4%)
    • Somalia (4.0%)

    Put another way, more than 95% of failed asylum seekers from these countries remain in the EU, despite having been told to leave.

    The above figures do not include illegal migrants who have not applied for asylum

    The official figures we have quoted above from the EU’s official statistics agency Eurostat do NOT include all those migrants who have entered the EU but who have not applied for asylum. The figures purely relate to asylum applications.

    The current influx of migrants crossing the English Channel from France, as highlighted in recent months by Nigel Farage, have often avoided asylum applications in all the EU countries they have travelled through. Their desire is to have a better life in the United Kingdom, where many see the benefit system as being significantly more generous than those on offer in France and other EU27 countries.

    The EU’s ‘New Pact on Migration and Asylum’

    The EU has been trying and failing to solve its immigration, asylum and settlement problems for years. Yesterday the EU Commission led by unelected EU Commission President Ursula von der Leyen announced details of its ‘New Pact on Migration and Asylum’.

    Given the widely divergent views of several countries, it seems highly likely that there will continue to be opposition to the Commission’s moves.

    Increased control from Brussels Centre

    This new Pact includes a Qualification Directive, Reception Conditions Directive, EU Asylum Agency Regulation, Union Resettlement Framework and Return Directive. As with all EU policies, Rules, and Directives, the Pact aims to standardise all matters relating to immigration, asylum and settlement across the 27 member states.

    For example the enhanced European Union Agency for Asylum will have “deployable Asylum Support Teams” to “assist” member states in the provision of services to migrants, and it will monitor all countries’ activities and standards “as a concrete form of European solidarity.”

    Some of the Commission’s statements would seem to leave the door open to a continued fudge. For example the statement that “Member States will continue to decide to whom and to how many people they will grant protection” is followed by a statement that “The Framework will be implemented through EU-wide plans, adopted by the Council on a proposal from the Commission, setting out a total number of persons to be admitted every 2 years.” Readers must make of that what they can.

    The EU and the UN believe in open borders

    It must be remembered that the official policy of the UN’s “International Organization for Migration” (IOM) is to have open borders for all migrants. This UN organisation is fully-supported and part-funded by the EU, as we have reported previously.

    The EU Commission says that its ‘New Pact on Migration and Asylum’ will “provide a stable EU framework for the EU contribution to global resettlement efforts.”

    Observations

    A country without borders isn’t a country

    The above statement should be self-evident to any normal person anywhere in the world. Unless, that is, you inhabit the grey and unaccountable corridors of the EU Commission’s headquarters in Brussels, or the UN’s grey and unaccountable corridors in New York or Geneva

    Inhabitants of those publicly-funded centres of privilege, with limos, expense accounts, and tax-free salaries do not have to live with the effects of uncontrolled immigration on the people living in real, local communities.

    Will the EU Commission’s ‘New Pact on Migration and Asylum’ work?

    As usual the EU has spent years trying to solve a problem and has come up with fudge after fudge, none of which have so far been agreed by all member countries.

    Despite all the EU’s continual claims of ‘unity’ and ‘solidarity’, the simple fact remains that some countries are unwilling to accept the consequences of Chancellor Merkel’s disastrous “all welcome here” announcement in 2015.

    Italy, Greece and Spain in particular are desperate for other EU member states to take in far more of their migrant influxes. Countries such as Hungary and Poland are still holding out.

    Based on our overnight assessment of the measures announced by the EU Commission yesterday, we see some positive movement in some areas of policy, but we can see no clear resolution to the problems of the Mediterranean countries which have borne the brunt of Mrs Merkel’s fiasco.

    Thank goodness we will soon be out of this

    The United Kingdom’s taxpayers continue to fund the EU’s migration problems – and will do for years to come – based on the terms of the thoroughly discredited Withdrawal Treaty.

    The continuing costs will be astronomical, as we have previously reported. Were Frau Merkel to offer to pick up the tab, this would be a start. Even then we doubt it would be enough to change the minds of the former Eastern Bloc countries, who wish to see moderate and controlled immigration and for asylum to be granted only to genuine refugees.

    We also continue to urge the unelected eurocrats in Brussels to repudiate the open borders policies of the UN’s migration agency (the IOM) which they back, and instead to pursue policies which could be supported by ordinary people living in the EU.

    No bank balances of globalist, foreign billionaires were harmed in the production of this report.

    Why on earth won’t the UK Government tell the World?

    An important and major report from Brexit Facts4EU.Org for MPs and World leaders

    The EU breaks international law and it does so as a principle

    1. The EU’s Withdrawal Treaty itself contravenes the Good Friday Agreement which is enshrined in international law
    2. The EU intends to put in border controls between Northern Ireland and the Republic of Ireland if there is no trade deal
    3. The EU breaks international laws regularly and with impunity
    4. The EU disregards WTO judgements against it
    5. The EU has already requested changes to the supposedly inviolable Withdrawal Treaty – five months after it was signed
    6. The EU is preventing a simple border solution and is disregarding international laws of the sea
    7. The EU has acted in bad faith throughout these EU-UK negotiations, breaking the terms of the Treaty

    The Remain-voting Minister Brandon Lewis knew what he was doing when he stated in Parliament that:

    “Yes, this does break international law in a very specific and limited way. We’re taking the powers to disapply the EU law concept of direct effect … in a certain very tightly defined circumstance.”

    The UK Government’s draft Internal Markets Bill does NOT break international law. Not at all.

    All it does is permit the United Kingdom to apply remedies
    in the event that the EU breaks international law.

    The Minister’s response to the question from another Remain-voting MP, Sir Bob Neil, was misleading and disingenuous. The true position is contained in the official Government statement issued by the Prime Minister’s office on 17 September 2020.

    This was a deliberate statement by a Remain-voting Government Minister which unnecessarily sent shock waves around the world. It has resulted in US Presidential candidate Joe Biden and House Speaker Nancy Pelosi all but blocking any idea of a free trade agreement with the UK.

    In light of this – and if the UK Government will not promulgate the truth about the EU’s systemic law-breaking – then it seems we must present the fundamental and indisputable facts of the EU’s intrinsic contempt for international law.

    The evidence – 1. The EU intends to contravene the Good Friday Agreement

    The EU’s Withdrawal Agreement itself contravenes the Good Friday Agreement (GFA), which is enshrined in international law and which is guaranteed by the United States. In its Constitutional Issues Section the GFA states that:-

    “the present wish of a majority of the people of Northern Ireland, freely exercised and legitimate, is to maintain the Union and, accordingly, that Northern Ireland’s status as part of the United Kingdom reflects and relies upon that wish; and that it would be wrong to make any change in the status of Northern Ireland save with the consent of a majority of its people.”

    The Withdrawal Agreement and Northern Ireland Protocol clearly alters the status of N.I. as part of the UK, without any consent of the voters. It thereby breaks the GFA. and in doing so breaks international law.

    The evidence – 2. The EU intends to put in border controls without a trade deal

    The UK has stated explicitly many times that it will not put any hard border between N.I. and the Republic of Ireland.

    Conversely the EU has never stated that it will not impose border controls. It is clear that in the event of no deal, the EU intends to make the N.I./Republic of Ireland border into a hard border.

    “If you push me to speculate on what will happen with a no-deal I think it’s pretty obvious. You will have a hard border.” – Margaritas Schinas, 22 Jan 2019, then Chief Spokesman, now EU Migration and Asylum Commissioner.

    Goods crossing the border from Northern Ireland into the Republic amount to no more than a rounding error in the EU’s import figures, totalling just 0.23% of all goods entering the EU. The N.I. border is a fictitious issue which has been used vexatiously by the EU in order to damage the constitutional integrity of the United Kingdom.

    In the last week the EU has even threatened to ban food products from the UK, in direct contravention of WTO rules.

    The evidence – 3. The EU breaks international laws regularly and with impunity

    It is an incontrovertible fact that the EU sets its autonomy above international law. Some individual EU member countries have even set their own autonomy above the international EU Treaties they have signed.

    “The obligations imposed by an international agreement cannot have the effect of prejudicing the constitutional principles of the EC Treaty”.

    These were the words of the European Court of Justice’s (ECJ) Advocate General Maduro in 2008, in the opinion underpinning the ECJ’s judgement in the case of Kadi and Al Barakaat International Foundation v. Council and Commission. These words were taken into the judgement itself. The ECJ was clearly sending out an unambiguous message about the autonomy of the EU legal order vis-à-vis international law and institutions.

    Interestingly, one of the main commentators on the Kadi case, Professor Gráinne de Búrca (NYU School of Law) wrote in 2009:

    “The judgement represents a significant departure from the conventional presentation and widespread understanding of the EU as an actor maintaining a distinctive commitment to international law and institutions.”

    Professor Gráinne de Búrca is not only an eminent academic in matters of law, in particular European Union law and international governance, but is also an Irish citizen.

    The evidence – 4. The EU takes no notice of the judgements of the WTO

    For 16 years the EU has been ignoring, appealing, and losing WTO judgements in respect of the actions brought by the US Government and Boeing against illegal state subsidies provided to the EU-made Airbus. This dispute has resulted in high tariffs being imposed by the US authorities against the EU, affecting UK goods such as Scotch whisky.

    Another example of the EU vs the WTO started In 2008, when the European Court of Justice held that the EU cannot be called upon to compensate for damages resulting from a failure of EU institutions to comply with WTO rulings. In the case in question, the damages were suffered by two Italian companies after the WTO Dispute Settlement Body authorized the United States to suspend tariff concessions against the EU. As in the Airbus case, this was another long-standing dispute.

    The evidence – 5. The EU has already requested changes to the Withdrawal Treaty, only five months after it was signed

    The supposedly inviolable and unchangeable Withdrawal Treaty (WT) has already been proposed by the EU to be changed after they noticed errors in it.

    In June the EU sought to “correct” parts of the WT. Below is just one example of the SEVEN points made in the EU’s decision about this, published in June 2020.

    “(5) By oversight, two decisions of the Administrative Commission for the Coordination of Social Security Systems were not listed in Part I of Annex I to the Withdrawal Agreement and eight acts which are essential for the application of the rules of the internal market for goods to Northern Ireland were not listed in Annex 2 to the Protocol on Ireland/Northern Ireland. Those decisions and acts should therefore be added to those annexes. In addition, three notes are also necessary to further define the scope of application of certain specific acts listed in Annex 2 to the Protocol on Ireland/Northern Ireland. These notes should therefore be added to Annex 2 to the Protocol on Ireland/Northern Ireland.”

    – Council Decision (EU) 2020/769 of 10 June 2020

    This makes a nonsense of the argument that the Withdrawal Treaty is inviolable. The EU itself already wishes to change it via the Joint Committee.

    The evidence – 6. The EU is preventing a simple border solution and is disregarding international laws of the sea

    Importantly, the EU and Irish Governments have prevented the Customs authorities of the UK and the Republic from speaking to each other to devise simple, alternative arrangements for the border between North and South – something crucial to preserve the integrity of the Good Friday Agreement.

    On the fundamental international laws of the sea, Monsieur Barnier has made the extraordinary assertion that whilst the UK will have future sovereignty of its coastal waters, the UK should have no such sovereignty over the fish swimming within these waters. In international law this is nonsense, as the UN’s UNCLOS rules make clear.

    The evidence – 7. The EU has acted in bad faith throughout these EU-UK negotiations, breaking the terms of the Treaty

    The UK is entitled under international law to expect third countries to act within certain international norms. Of course the EU isn’t a country but it likes to behave like one and is acting on the instructions of its 27 Member States, all of whom are obliged by international law to abide by certain UN Resolutions. Looking at just one of these: UN Resolution 2625 on “Principles of International Law Concerning Friendly Relations and Co-operation Among States” it requires, amongst other things, that:

    ”No State may use or encourage the use of economic, political or any other type of measures to coerce another State in order to obtain from it the subordination of the exercise of its sovereign rights and to secure from it advantages of any kind.” and

    ”Every State shall refrain from any action aimed at the partial or total disruption of the national unity or territorial integrity of any other State or country.”

    It is evident that the EU has acted in bad faith throughout these negotiations between the United Kingdom and the EU. This alone allows the British Government to repudiate the Treaty and pursue actions in the interests of the country and its people.

    The EU’s intent was clear from the outset.

    “This will not be an amicable divorce”

    – Commission President Jean-Claude Juncker, 24 June 2016

    This set the tone for all future discussions and was followed by a raft of EU diktaks, none of which were based in law.

    For example, the EU forbade the UK from speaking to governments around the world about future trading relations. It even forbade the UK from speaking to the individual governments of EU member countries.

    The EU has quite evidently not acted ‘in good faith’ and nor has it used its ‘best endeavours’. It has consistently attempted to impose unreasonable restrictions on withdrawal and trade talks with the UK. The EU has insisted (and is still insisting) on discussing its red lines first, before talking about the details of a trade agreement.

    During these supposed trade talks the EU has imposed restrictive clauses on the UK which it has not used on any other major country in trade negotiations. These demands are not in any way consistent with the conditions which prevail in any free trade agreement between any other major countries in the world.

    In short, the EU has acted in a punitive and hostile manner towards the United Kingdom, and the UK is now within its rights under international law to repudiate the Withdrawal Treaty on this basis.

    Observations

    This report has principally been prepared for British MPs and for legislators worldwide, and in particular for Members of the US Congress.

    It aims to set the record straight when looking at the final stages of the United Kingdom’s withdrawal from the European Union, in terms of some of the key legal facts.

    The United Kingdom Government has not broken international law

    Indeed the record of the United Kingdom is exemplary when compared to that of the European Union, as we have shown above.

    The EU habitually breaks international law and fails to abide by the judgements of the WTO, insisting that its own laws are paramount. Members of Congress will be familiar with the high profile case involving Boeing and Airbus, for example.

    The messaging has been dire but the message is sound

    Sadly, the UK Government’s performance in communicating the salient facts to its own public and to the wider world have been lamentable. We hope that the worldwide audience will appreciate that whilst the communication has been dire, the facts are another matter.

    The facts show that the EU is an habitual breaker of international law, that its own Withdrawal Treaty breaks the terms of the Good Friday Agreement, that it has treated the United Kingdom like a colony to be oppressed, and that the UK has acted with enormous restraint under all these circumstances.

    An increasing number of MPs in the UK Parliament are now of the view that the EU has not acted in good faith nor used its best endeavours, as required by the Withdrawal Agreement and Northern Ireland Protocol. There is now a very solid case for the UK Government to repudiate the EU’s Withdrawal Treaty forthwith.

    The World can continue to rely on the United Kingdom

    The United Kingdom remains what it has always been: an originator and upholder of freedom, democracy, and the rule of law.

    We sincerely hope to have the support of our many friends around the world in our determination to ensure that a fully free, independent, and sovereign United Kingdom can once again play its role on the world stage, unencumbered by totalitarian diktats from unelected officials in Brussels.

    How do goods exports affect our economy?

    Brexit Facts4EU.Org recently published the data on how our goods exports affect the UK’s economy. The facts are that goods exports are a small part, because of the UK’s strong services sector which dominates by a factor of almost 4:1.

    Nevertheless our goods exports to the rest of the world are becoming increasingly significant. Below we show just one part of our research, which demonstrates clearly how the rest of the (non-EU) world is of far more importance to the UK’s GDP, and how its influence is growing.

    Trade deals

    In 60 years the EU has never managed to negotiate a trade deal with the largest economy on the planet : the United States. It has no trade deal with the second-largest economy: China.

    In that same 60 years the EU has only just managed to do a deal (still not ratified) with the world’s third-largest economy: Japan. The United Kingdom Government managed this is in just eight months since leaving the EU (in name only) on 01 February 2020.

    Trade deals are not required to do trade, but they can help. The vast majority of the world’s economies and businesses trade with the EU without a trade deal. No Single Market, no Freedom of Movement, no massive annual payments, no Level Playing Field, no Northern Ireland Protocol, nothing. Just normal WTO rules.

    The myth of the EU’s Single Market and Customs Union

    At present, UK companies can sell their goods to EU27 countries with no tariffs. The EU’s Customs Union is supposedly a tariff-free zone for EU members. The Single Market supposedly imposes common standards. These are facts which were lauded by all those who campaigned for Remain in the EU Referendum of 2016 and ever since.

    A simple question must therefore be asked. If the EU’s Single Market and Customs Union are so essential to be a part of, why have the UK’s sales outside the EU increased by 14.1%, when the UK’s sales to the EU have fallen by 1.2%?

    Observations

    These are facts you will not see on the BBC, Sky News, or ITN

    The above facts come from our analysis of the official figures from the Office for National Statistics. They are freely available to all news organisations, and yet they are not reported.

    Sky and ITN are commercial organisations, although they are still supposedly regulated by OfCom. The BBC on the other hand is publicly funded by licence payers and by the Government. Their endemic bias is so palpable in their news and current affairs output that the case for defunding that part of the organisation at the very least is clear. If they cannot adhere to their Charter, they are not fit for purpose.

    An independent United Kingdom freed from the EU can do even better

    Whenever we publish the research we have conducted, presenting facts which reflect badly on the EU, we suffer attacks from those who have never accepted the democratic decision of the British people in 2016 to leave the European Union.

    One line of attack from Remoaner-Rejoiners is “Well, this just shows how we can stay in the EU and still sell around the World.” People like this completely miss the point.

    We suggest that Remoaner-Rejoiners should try selling into France and see how they get on. Members of our team with this direct experience would rather sell to a company in Phoenix Arizona – even with tariffs – than to a company in Marseilles in the South of France.

    A sense of pride and confidence may be returning

    We believe that what is now changing is a feeling amongst business people that the United Kingdom will soon, once again, be a free and independent trading nation, unshackled by EU regulation.

    Since 01 January 1973 when the UK joined what was then the Common Market, the British people have been subdued, thinking that the UK was just one small player in a massive EU trade bloc. This was always wholly untrue.

    The fact is that, thanks to the Customs Union the UK became a captive market for the other EU countries. This is why German businesses refer to us as “Treasure Island”. The UK is the country that benefited least from the Single Market, as the EU Commission itself admits and which we have previously reported.

    Now we sense a feeling of national pride returning, as more and more businesses feel ready to embrace the global market, unencumbered by EU rules and regulations, and ready to present excellent British products and services to all our friends around the world. We also see these international friends increasingly keen to buy British.

    we can’t wait to see the United Kingdom’s full and mighty potential unleashed.

    Disturbing, globalist EU witterings from the President of a wannabe superstate

    Yesterday in Brussels the unelected President of the EU Commission addressed the EU Parliament for almost an hour and 20 minutes in her “State of the Union” speech.

    This address is a relatively new EU delusion of grandeur based on the tradition of the US President’s annual State of the Union speech to the US Congress, as if the EU were a country. Out of a very long speech we have picked out a few sections which caught our attention.

    On the EU’s disastrous inability to respond to COVID-19

    “We turned fear and division between Member States into confidence in our Union. We showed what is possible when we trust each other and trust our European institutions.”

    The EU failed to help Italy at the height of its COVID crisis, (for which the EU is still not forgiven by Italians), but Frau von der Leyen is proud of what the EU did for non-EU citizens thousands of miles away:-

    “In the pandemic, European planes delivering thousands of tonnes of protective equipment landed everywhere from Sudan to Afghanistan, Somalia to Venezuela.”

    No minimum wages in EU law (but they exist in UK law)

    Remainers still talk of Brexit as meaning the abandonment of supposed EU protections on matters such as workers’ rights. We have published many research reports showing that it’s UK law that protects workers’ rights, and that the EU has done almost nothing.

    Below Frau von der Leyen is forced to admit that the EU has no protections in place.

    “This is real European solidarity in action. And it reflects the fact that in our Union the dignity of work must be sacred. But the truth is that for too many people, work no longer pays. Dumping wages destroys the dignity of work, penalises the entrepreneur who pays decent wages and distorts fair competition in the Single Market.

    “This is why the Commission will put forward a legal proposal to support Member States to set up a framework for minimum wages. Everyone must have access to minimum wages either through collective agreements or through statutory minimum wages.”

    Conclusive proof from the EU President of what we have stated many times before: the EU does not even have a minimum wage law.

    The Single Market still isn’t working

    Who knew? The Single Market isn’t working. This is the Single Market which the EU started on 01 Jan 1993, over 25 years ago.

    “We must tear down the barriers of the Single Market. We must cut red tape. We must step up implementation and enforcement. And we must restore the four freedoms – in full and as fast as possible.”

    Readers may wish to note that the EU President talks of restoring the four freedoms. This necessarily means that the EU’s own laws have been broken across the EU, as these four freedoms are supposed to be sacrosanct.

    Big Brother – Soon you won’t even be able to rent a bike without an EU identity card

    Personal freedom and civil liberties? No. EU citizens will soon all be on a central database, unable to do anything without an “EU E-Identity” card. It seems they won’t even be able to rent a bicycle.

    “That is why the Commission will soon propose a secure European e-identity. One that we trust and that any citizen can use anywhere in Europe to do anything from paying your taxes to renting a bicycle.”

    Brexit – no great surprises here

    “But talks have not progressed as we would have wished. And that leaves us very little time. As ever, this House will be the first to know and will have the last say. And I can assure you we will continue to update you throughout, just as we did with the Withdrawal Agreement.

    “That agreement took three years to negotiate and we worked relentlessly on it. Line by line, word by word. And together we succeeded. The result guarantees our citizens’ rights, financial interests, the integrity of the Single Market – and crucially the Good Friday Agreement.

    “The EU and the UK jointly agreed it was the best and only way for ensuring peace on the island of Ireland. And we will never backtrack on that. This agreement has been ratified by this House and the House of Commons. It cannot be unilaterally changed, disregarded or dis-applied. This a matter of law, trust and good faith.”

    We would merely point out to Frau von der Leyen that there is now an accepted legal case for the UK to repudiate the entire Withdrawal Treaty on the grounds that the EU has not acted in good faith throughout all the discussions and negotiations.

    Anyone a fan of globalisation?

    The EU is.

    “We will work for just globalisation.” (This was highlighted in bold in her speech.)

    Do you have an alternative opinion to the EU Commission?

    Sorry, that will soon be banned.

    “The Commission is putting forward an action plan to start making that happen. As part of this, we will propose to extend the list of EU crimes to all forms of hate crime and hate speech – whether because of race, religion, gender or sexuality.”

    Couched in terms designed to sound relatively innocuous, the reality of the EU’s control on your freedom of expression will go much further. And readers will note the reference to “EU crimes”. We will publish more detail on this in due course.

    We do agree with the unelected EU President on one thing

    “Honourable members, the people of Europe are still suffering.

    “It is a period of profound anxiety for millions who are concerned about the health of their families, the future of their jobs or simply just getting through until the end of the month.”

    At least she got that part right. Not that the EU will help with any of that….

    Observations

    This is the EU which is coming

    We warned about it before the EU Referendum (and since) but of course the mainstream media failed to cover it. Back in 2016, those who voted Remain thought they were voting for the status quo. They weren’t. They were unknowingly voting for an inreasing totalitarian and dystopian nightmare.

    Many Remain voters have now learnt more about the EU and have changed their minds. Sadly it often seems to be politicians – who should be better informed than the public – who continue to be blind to the realities of the EU, despite the EU’s constant hostilities towards the United Kingdom since we voted to leave their ideological construct.

    Yesterday Ursula von der Leyen tried to put a positive spin on things. In this she is helped on a daily basis by the relentless stream of propaganda emanating from the Brussels PR machine.

    Once again we urge the UK Government to increase significantly its efforts to inform the people of the United Kingdom and the world of the truth about the EU.
